Frank H. Bailey is the founder and managing partner of The Bailey and Oliver Law Firm. For 36 years Frank has represented clients who have been injured in his community and throughout Arkansas. Frank believes that his integrity and hard work led to him being named Trial Lawyer of the Year in 2009 by the Arkansas Trial Lawyers Association.
Frank likes to tell the stories of the families he has helped over the years. One of his favorite stories is about an elderly couple that had gone to a Savings and Loan to invest their life savings. The president of the Savings and Loan convinced them to give the money to him and he would pay them a higher rate of interest than they could get from the Savings and Loan Association. Of course, when they asked for their money back it wasn’t there. Frank sued the Savings and Loan along with the offices utilizing the new RICO law which stands for Racketeering Influenced Corrupt Organization. The Federal Judge immediately wrote back saying, “You have ten days to show me why this case shouldn’t be dismissed.” Frank worked day and night, the case was not dismissed and the couple got all of their money back.
Another one of Frank’s stories concerns a surgeon he called, “Dr. Death.” The surgeon had so many infections, and so many people died at his hands that Frank sued the hospital for negligent credentialing, which was a new theory just taking root in the law. Frank spent weeks traveling from hospital to hospital where the surgeon had practiced to prove the surgeon should not have been allowed to have operating privileges. The jury found for Frank’s client. The hospital appealed to the Supreme Court. The Court found in favor of Frank’s client who recovered the largest verdict in the history of that county.
Another time Frank mediated a serious car wreck that had put his client in the hospital for weeks. There were two defense lawyers at the mediation. During the mediation one of the lawyers said, “Frank, you will never get a jury in Arkansas to allow that much money for your client.” The other defense lawyer said, “Maybe not, but I have researched it, and Frank has the largest verdicts in Baxter, Marion, and Boone counties.” The case settled shortly after that.

Frank Bailey has over 35 years of experience in trying personal injury cases. In 2009, he was named as the Outstanding Trial Lawyer of the Year from the Arkansas Trial Lawyers Association.
At a young age, Frank was drafted into the Army and was attached to the 101st Airborne Division in Vietnam. After receiving an Honorable Discharge from the Army, Frank attended the University of Arkansas School of Law in Fayetteville, Arkansas. Upon graduating, Frank began practicing law on the square in Mountain Home, Arkansas. It wasn’t long until his practice grew. Now, Frank has over 35 years of experience in trying personal injury cases.
In 1988, Frank became Board Certified as a Civil Trial Specialist by the National Board of Trial Advocacy. Frank has been appointed three times to serve as a Special Associate Justice to the Arkansas Supreme Court and is currently the only Diplomate of the National College of Advoacy practicing in Arkansas. Frank is the immediate past President of the Mountain Home Chamber of Commerce and is a member of the Baxter Regional Hospital Foundation Advisory Board. Frank is named in the 2006, 2007, 2008, 2009 and 2010 editions of Mid South Super Lawyers. He is rated AV, Martindale Hubbell’s highest rating. Frank is included in the 2008, 2009, and 2010 editions of The Best Lawyers in America under the specialty of Personal Injury Litigation.
Frank’s wife Pat is the Provost and Vice Chancellor at Arkansas State University Mountain Home and has served as President of the Arkansas Two Year College Association, President of the Mountain Home Rotary Club, and President of the Mountain Home Chamber of Commerce.
